Innovative School Tools LLC (“we” or “us” or “our”) respects the privacy of our users (“user” or “you”). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our Website and Products collectively “Services”), which are comprised of:

  • our products and services (“Products”), including the following:

We reserve the right to make changes to this Privacy Policy at any time and for any reason. If we make changes to our Privacy Policy, we will announce and post such changes on the on the main page of our website, and we will post the “Revised” date of this Privacy Policy at the top of this page for the general public. If you are a Customer, we will also notify you of the changes via email (using the email address you provided), so you can review any changes that are made. Additionally, we will ask you to consent and accept the changes at the time of your next account login on TeachersInTouch. By continuing to use the TeachersInTouch service, after such notice and consent, you are bound by our Privacy Policy as modified.

1) COLLECTION OF YOUR INFORMATION

We collect two basic types of information:

A) Personally, identifiable information (PII): PII is information that personally identifies one individual from another. This information is voluntarily provided to us by you when you register on our website in order to use our service. We collect this information directly (e.g., information collected when signing up to use our Products) from school personnel and other users.

B) Automatic Information: Automatic Information consists of information that is anonymous in nature and does not identify you as an individual. This includes your computer IP address, unique mobile device identifier, browser type, ISP or carrier name, and the URL of the last web page you visited before visiting our website, which is used anonymously in aggregate.

A. Personally, identifiable information (PII):

a. School Personnel’s Information

When teachers, admin and other school personnel register for our Product through our Website, we request information necessary to set up a school or a school teacher’s trial account (or paid account) to use our Products. For example, we may ask for a school teachers name, email address, telephone number, and home State that you voluntarily give to us when you set up our Products or when you choose to participate in various activities related to the Website, such as receiving our newsletters. You are under no obligation to provide us with personal information of any kind, however your refusal to do so may prevent you from using certain features of the Site.

b. Student Information Data

Student Information data is collected on behalf of a school via a school’s TeachersInTouch account. Since we operate on behalf of schools, Student Information Data is the property of and under control of the school always.

School Personnel, Schools and School Districts that use our Product house in it information that is typically found in a school’s or school district’s Student Information System (SIS), such as the student’s name, birthdate, grade level, home address, parent or guardian contact information, etc. A school teacher, a school entity, or school district that uses our Products will also collect anecdotal comments about students, attendance-related information, behavior-related information and student-related comments that are associated with grades.

The practices and terms set forth in this Policy are mostly relevant and addressed to “you” as an educator. Therefore, all references to “you” or “your” refer to adult users, unless specifically noted otherwise.

As an educator you have access to personally identifiable information from your students. Please be reminded that it is your responsibility to comply with any privacy policies maintained by your employer, school, or institution regarding any of your information that you may choose to share with us. Innovative School Tools, LLC. disclaims any liability for any breach of privacy under the terms of any privacy agreement that you, your employer, or your institution may have with your students, their parents, or their guardians.

B. Automatic Data

a. Cookies

Innovative School Tools LLC uses “cookies” to collect session information about individual Users’ visit to provide contractual services. When an authenticated user logs off, cookies are emptied. Please be aware, however, that if you choose not to store a cookie, you will need to login repeatedly, because cookies are what we use to manage your sessions. “Cookies” are small pieces of information that are transferred to your browser and stored on your computer’s hard drive. Our cookies enable us to provide you with more personal service. Cookies also allow us to track usage patterns, trends and other aggregate visitor information on our Website. Most web browsers automatically accept cookies, but you can usually change your browser to prevent that if you would rather not store the information for future use. We may also collect certain technical and routing information about your computer to facilitate your use of the site and its services (such as browser type, operating system and the Internet Protocol (“IP”) address of your computer). We do not match such information with any of your personal information without expressly informing you in each instance.

We may also partner with selected third-party vendors, such as Google Analytics, to allow tracking technologies on the Website through the use of first party cookies and third-party cookies, to, among other things, analyze and track users’ use of the Site, determine the popularity of certain content and better understand online activity. By accessing the Website, you consent to the collection and use of your information by these third-party vendors. You are encouraged to review their privacy policy and contact them directly for responses to your questions. We do not transfer personal information to these third-party vendors. However, If you do not want any information to be collected and used by tracking technologies, you can visit the third-party vendor or Network Advertising Initiative Opt-Out Tool or DigitalAdvertisingAllianceOpt-OutTool.

You should be aware that getting a new computer, installing a new browser, upgrading an existing browser, or erasing or otherwise altering your browser’s cookies files may also clear certain opt-out cookies, plug-ins, or settings.

c. Log Data

Like most websites, we collect and store (via our consumer facing website) automatic information about how you navigate through the site. Data collected may include IP address, timestamps, device information, and crash or error details.

d. Financial Data

Financial information, such as data related to your payment method (e.g. valid credit card number, card brand, expiration date) that we may collect when you purchase, order, return, exchange, or request information about our services from the Product. We store only very limited, if any, financial information that we collect. Otherwise, all financial information is stored by our payment processor, Stripe, and you are encouraged to review their privacy policy and contact them directly for responses to your questions.

2) HOW WE USE DATA COLLECTED FROM OUR WEBSITE

We use information collected through our Website or disclosed by you on our Website to:

  • A. Register or create an online Innovative School Tools, LLC. educator account (both of which may be referred to in this Policy as a “Innovative School Tools, LLC. account” or “your account”)
  • B. Sign-up for newsletters, product announcements, marketing or other communications
  • C. Contact or communicate with Innovative School Tools, LLC. Customer Support
  • D. Email you regarding activation of your Product account.
  • E. Increase the efficiency and operation of our Website.
  • F. Monitor and analyze usage and trends to improve your experience with our Website.
  • G. Resolve disputes and troubleshoot problems.
  • H. Submit testimonials, success stories, or product ideas.

3) HOW WE USE PERSONAL IDENTIFIABLE INFORMATION

We will use Personal Student Information to provide our contracted educational Product(s) for K-12 schools.

We will not use your personal identifiable information in any way other than in connection with providing the Services, as described in this Policy, as directed by a teacher or school, or upon obtaining your consent.

We do not sell Personal Student Information. We do not use Personal Student Information to target advertisements or market to students or anyone else, or for any purposes prohibited by the Family Educational and Privacy Rights Act (20 U.S.C. § 1232g; 34 CFR Part 99.3) (“FERPA”), California Business & Professions Code section 22584 (“SOPIPA”), and California Education Code section 49073.1. We will not use Personal Student Information for any purpose other than those required or specifically permitted by our Privacy Policy, and our Products Terms of Service, or any other agreement between a school and us.

4)SHARING OF PERSONAL STUDENT INFORMATION STORED

Innovative School Tools LLC does not share student information data that is hosted on its platform except as follows:

  • A. If your school or school district request the data;
  • B. If a third-party service provider, consultant, and other service provider who performs certain business-related services for us and need access to your student’s information to do work in a manner consistent with this Policy (for example, our web hosting provider, or our transactional email service provider);
  • C. To comply with laws or to respond to lawful requests and legal process;
  • D. In connection with or during negotiation of any merger, financing, acquisition, bankruptcy, dissolution, transaction or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets to another. company, in which case the company receiving the personal information would be obligated to comply with the commitments of this Policy.

5) RETAINING YOUR INFORMATION

Innovative School Tools LLC. retains data for the duration of the contract with the school or school district. Upon contract expiration, data is retained for an additional 60 days, unless otherwise requested by the district. After 60 days, according to internal policy, all data is permanently deleted. Any data exchanged with third party service providers will be deleted or transferred, per District request when they are no longer needed, or at contract expiration. If an Institution opts out of our Service(s), all data associated with the Primary Users at the Institution is immediately deleted and destroyed using a custom script.

6) PROTECTION OF INFORMATION

Innovative School Tools, LLC. uses a variety of organizational, technical, and physical safeguards to help protect the security of your personal information (i.e., to prevent it from being lost, destroyed, stolen, misused, or accessed by an unauthorized person).

Our website uses Secure Socket Layering (SSL) to encrypt information including user login and password, user account content, credit card numbers etc. All actions that involve the digital transmission of Personal Data are handled by a 256-bit SSL (Secure Sockets Layer) encryption; we also employ daily data backups on our Digital Ocean production servers.

Additional measures include, but are not limited to:

  • A. Storing your personal information that are only accessible to authorized Innovative School Tools, LLC. employees on a strict need-to-know basis; and,
  • B. Requiring our online users to verify their identities with unique login information before they can access or modify their Innovative School Tools, LLC. account information or settings.
  • C. Setting mobile application default to require log-in upon launch.
  • D. A Forgot Password option
  • E. An Automatic Logoff (when the system is inactive for more than 25 minutes)

You can also play a role in helping keep your personal information safe. If you are required to create a unique password to restrict access to your account, choose a password that has a combination of letters, capital and lower-case letters, symbols, or numbers), and be sure never to reveal it to anyone else. It is your responsibility to keep your password and account information confidential at all times. If you use a shared or public computer, never choose to have your login information remembered and make sure to log out of your account and close the browser every time you leave the computer.

7) POLICY EXCLUSIONS

A. This policy does not apply to websites or practices of companies that Innovative School Tools, LLC. does not own or control, or to individuals that Innovative School Tools, LLC. does not employ or manage. In addition, we are not responsible, and disclaim any and all responsibility, for the practices or content of the third-party websites.

8) HOW TO ACCESS AND MODIFY INFORMATION

A. Parents, Legal Guardians, and Eligible Students: Upon request and in accordance with applicable law, we may disclose certain Personal Student Information collected through our Products that we and our agents have about you or your child so that you may review and/or request changes in the accuracy of such information. If you wish to request a review or correction of your child’s records, please contact the appropriate official in your school district and ask them to collaborate with the TeachersInTouch team to carry out this action. We will use commercially reasonable efforts to process such requests in a timely manner in accordance with applicable law.

9) CHILDREN

Innovative School Tools, LLC. recognizes the importance of protecting children. For this reason, we will not knowingly collect or solicit any personal information directly from anyone under the age of 18. We will never request personally-identifying information from a Child.

A. We will only collect children’s personal information from adults. Innovative School Tools, LLC.’s online data collection activities are primarily targeted towards educators and parents, and thus we do not collect personal identifiable information (defined above) from users that we know to be children. If we seek personal information about children, we will always request this information directly from an educator, or other adult (but not the child). In addition, if any children’s information is stored as part of the corresponding adult’s Innovative School Tools, LLC. account (not a child’s account), it can only be accessed by the adult account owner.

B. Users and especially Children should note that any personally-identifying information that is voluntarily posted to any public area of this website may always be collected and used by others. While we monitor such posting areas from time to time and will use commercially reasonable efforts to delete a Child’s personally-identifying information prior to posting, we strongly encourage children not to post such information.

10) ELECTRONIC COMMUNICATION

If you provide us your email address or phone number, we may send you email or text message communications. By maintaining an account with Innovative School Tools, LLC. and/or by failing to opt out of the receipt of information hereunder, you acknowledge that you may receive e-mail or text messages on your phone or mobile communications device, and that the receipt of such messages may cause you to incur usage charges or other fees or costs in accordance with your wireless or data service plan. Any and all such charges, fees, or costs are your sole responsibility. You should consult with your wireless carrier to determine what rates, charges, fees, or costs may apply. We may receive a confirmation when you open an email from Innovative School Tools, LLC. if your computer supports this type of program. Innovative School Tools, LLC. uses this confirmation to help us make emails more interesting and helpful.
